MetabolIQ AI Inc. ("we," "us," or "our"), a company based in Toronto, Canada, is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you use our platform and its features (the "Service").
Depending on your location, your personal information is protected by the data protection laws that apply to you. For users in Canada, we comply with PIPEDA and, in Québec, with the Act respecting the protection of personal information in the private sector (Law 25). For users in the EU or EEA, we comply with the GDPR. For users in California, we comply with the CCPA, as amended. Where other data protection laws apply, we comply with those.
Information We Collect
We collect the following types of data to provide and improve the Service:
Account Information: When you sign up, we collect your name, your email address and password (or authentication credentials).
User Content: This includes the text prompts, layouts, and data you input into your workspaces to interact with our AI tools.
Technical Data: We collect server logs, IP addresses, and device information strictly for security and debugging purposes.
Usage & Analytics Data: We collect information about how you access and use the Service. This includes data on the features you interact with, the time spent on specific parts of the platform, and your navigation paths. We use third-party analytics providers (e.g., Mixpanel, Google Analytics) to help us understand these usage patterns.
Cookies: We use cookies and similar tracking technologies to track activity on our Service and store certain information as follows:
Essential Cookies: Required for you to log in and use the Service.
Analytics Cookies: Used to collect data on how the Service is being used. You have the right to opt-out of these non-essential cookies via our cookie consent banner or your browser settings.
How We Use Your Information
We use your data for the following purposes:
To Provide the Service: To render your workspaces, process your AI requests, and manage your account.
To Communicate: To send you critical service updates (e.g., downtime notices, security alerts) or other service-related information.
To Ensure Security: To detect and prevent abuse, fraud, or technical issues.
To Improve our Product: To analyze aggregated usage trends and user behavior in order to fix usability issues, prioritize new features, and refine the user experience. Further described in Section 5.3.
International Data Transfers
4.1 Location of Data: Our servers and main operations are located in Canada (Toronto and Montreal). Your content may be processed by third-party model providers located in other countries solely to generate responses for you. Where a separate agreement requires it, processing and residency can be restricted to your jurisdiction.
4.2 Cross-Border Transfers: Where your personal information is transferred across borders, we rely on the transfer mechanisms available under the data protection laws that apply to you. For example, for transfers from the EU or EEA to Canada, we rely on the European Commission's adequacy decision for Canada, which recognizes that Canadian law provides comparable protection. Where other transfer mechanisms are required, they are agreed in the applicable organizational agreement.
Artificial Intelligence and User Content
5.1 AI Processing: MetabolIQ AI uses Artificial Intelligence (AI) to generate suggestions and content within your workspaces. When you interact with the AI, your inputs (text prompts and workspace context) are sent to our AI providers solely for the purpose of generating a response.
5.2 Data Privacy (No Training): We do not use the content of your work to train foundation models or any model that could reproduce or memorize it. Your content is sent to model providers, which may be located in other countries, only to generate responses for you. Zero data retention and jurisdictional data residency are available under a separate organizational agreement.
5.3 Aggregated Insights: We generate and use de-identified, aggregated insights derived from use of the Service, including patterns in how individuals and groups reason and collaborate. These insights do not identify you or your content and cannot reasonably be used to do so. They are owned by us and form part of the Service's underlying technology.
Data Retention
We retain your personal data only for as long as your account is active or as needed to provide you the Service.
Account Cancellation: If you choose to cancel your subscription, or if your organization's contract ends, we will provide a grace period of 30 days for you to export your data. After this period, your account data and User Content may be permanently deleted or anonymized.
Your Rights
You have rights over your personal information. Depending on where you live, these include:
Right of Access: You can request a copy of the personal data we hold about you.
Right to Rectification: You can ask us to correct inaccurate data.
Right to Erasure: You can ask us to delete your account and associated data.
Right to Restriction: You can ask us to pause processing your data in certain scenarios.
Right to Portability: You can request your data in a structured, commonly used format.
These rights are available to residents of Canada and Québec under PIPEDA and Law 25, to residents of the EU and EEA under the GDPR, and to residents of California under the CCPA. To exercise any of these rights, contact us at privacy@metaboliq.ai. We will respond within the timeframe required by the applicable law, and in any event within 30 days.
Notice to US Residents (California & Others)
This section applies to residents of the United States, specifically including California (CCPA/CPRA).
We Do Not Sell Your Data: We do not sell your personal information for monetary value.
Service Providers: We share data with third-party service providers (such as analytics or AI processors) strictly for business purposes defined in this policy. These providers are contractually prohibited from using your data for any other purpose.
Age Requirements
The Service is not intended for individuals under the age of 16. By registering, you confirm that you are at least 16 years old. If we discover that we have collected data from a user under 16 without parental consent, we will delete it immediately.
